Ponna Rao, learned Deputy Solicitor General, for the respondents. 2. Impugning the proceedings No. MoRTH/PIU/ARAKU/Consultancy/ SATRA/NH-516E dated 17.04.2025 issued by respondent No.2, rejecting the petitioner’s representation and upholding the letter No.MoRTH/PIU/ ARAKU/Consultancy/SATRA/NH516E, dated 13.01.2025, whereby penalty was imposed on the petitioner, the above writ petition is filed. SRS,J W.P.No.10341 of 2025 3. At the hearing, on 22.04.2025, learned counsel for the petitioner confined arguments and urged that the petitioner will invoke clause 9.2.1.(b) of the agreement, as observed by the Court, in its order dated 27.01.2025, in W.P.No.1396 of 2025. Learned Deputy Solicitor General sought to get instructions. 4. Today, learned counsel submitted that the petitioner has proposed to appoint Sri M. Satyanarayana Murthy, retired Judge of the Andhra Pradesh High Court as arbitrator, on its behalf. 5. Learned Deputy Solicitor General would submit that the respondents will appoint their arbitrator within ten days from today. 6. Given the above submissions and the facts and circumstances of the case, without going into merits of the matter, this writ petition is disposed of at the admission stage, with the consent of learned counsel on either side directing the respondents to appoint arbitrator on their behalf, in terms of clause 9.2.1(b) of the agreement, within ten days from today, since the petitioner already indicated the name of the arbitrator on its behalf. No costs.
