Mr. Anil Kumar Joshi, Advocate, for the petitioner. Mr. Narayan Datt, Standing Counsel, for the State. (2) Petitioner is serving as Assistant Teacher, Govt. Primary School, Sheeshamjhari, Block Narendra Nagar, District Tehri Garhwal. She was transferred to Govt. Primary School, Domasi, Jaunpur, District Tehri Garhwal, vide order dated 24.6.2023. Thus feeling aggrieved by her transfer, petitioner has filed this writ petition. (3) It is contended by learned Counsel for the petitioner that petitioner is a widow, who has to singlehandedly look after her m inor child, therefore, as per the provisions of Transfer Act, she is entitled to special treatment. (4) Learned State Counsel, per contra, subm its that on the date petitioner was transferred, she had already put in more than nine years of service at Sugam places. He further subm its that petitioner fell within 15 per cent of such teachers, who came within the purview of transfer, as per the Transfer Act, therefore she was transferred to Domasi. Learned State Counsel points out that coordinate Bench of this Court had passed an interim order in favour of petitioner on 20.10.2023, pursuant to which, petitioner is still continuing at her original place of posting. (5) This writ petition was filed in 2023 2025:UHC:10174 and petitioner has already served for more than two years at the place where she was already serving, on the strength of interim order passed in her favour, therefore, no useful purpose would be served by keeping the writ petition pending. (6) Writ petition is, accordingly, disposed of with liberty to the petitioner to make a representation regarding her transfer to the competent authority. If she makes such representation within two weeks from today, decision thereupon shall be taken, as per law, within six weeks thereafter. For a period of eight weeks or till decision is taken, whichever is earlier, status quo as regards petitioner’s posting shall be maintained.
