The present applicant ‘Ram Gopal Nath @ Ram Gopal Singh’ praying for bail in reference to First Information Report dated 18.10.2024 bearing FIR No. 337 of 2024 P.S. Kankhal, District Haridwar, wherein, the present applicant along with four others namely Ashok Kumar, Saurav, Lalit and Pradeep have been implicated for the offences punishable under Sections 302 r/w 201 and Section 120B of IPC. 4. It is contended by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated and languishing in jail since 19.10.2024. Learned counsel for the applicant further argued that there is no recovery on pointing out of the present applicant and even there is such intention or motive of the applicant in the commission of crime. She further argued that the name of the applicant infact has been disclosed by the main accused Ashok Kumar in his confessional statement, which is not admissible and as a matter of fact applicant was engaged as a care taker in the Ashram after the said alleged incident. 5. Apart from this, she argued that it is a case in which the dead body was not recovered and there is no any direct evidence which establishes the involvement in the offence. Apart from this, she argued that the charge-sheet has already been filed and there is no need of custodial interrogation of the present applicant. She further argued that the other co-accused namely Sanjeev Kumar Tyagi have already been enlarged on bail. 6. On the other side, learned State counsel have not disputed this fact that the charge-sheet has already been filed and the present applicant is languishing in jail since 19.10.2024 and also apprise that the applicant has no previous criminal history, however Mr. Sandhu submits that after collecting all sufficient material the applicant has been chargesheeted. 7. After hearing the arguments of learned counsel for the parties and further taking into consideration that the present applicant is languishing in jail since 19.10.2024 and the charge-sheet has already been filed and there is no need of the custodial interrogation of the present applicant and furthermore, the other co- accused has already been enlarged on bail and the applicant has no previous criminal history, this court is of the view that the applicant deserves for bail. 8. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed. 9. Let the applicant ‘Ram Gopal Nath @ Ram Gopal Singh’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned. 10.
