AND P.S. -HAILAKANDI, PIN- 788155. VERSUS THE STATE OFSSAM AND ORS REPRESENTED BY THE SECRETARY, TO THE GOVERNMENT OF ASSAM, DEPARTMENT OF SCHOOL EDUCATION, DISPUR, GUWAHATI- 06. Advocate for the Petitioner : MR. A Y CHOUDHURY, Advocate for the Respondent : SC, ELEM. EDU,
BEFORE HONOURABLE MR. JUSTICE ROBIN PHUKAN ORDER Date : 25.02.2025
Heard Mr. A.Y. Choudhury, learned counsel for the applicant. Also heard Ms. S. Konwar, learned Standing counsel for the opposite parties. Page No.# 2/3
2. This interlocutory application is preferred by the applicant, namely, Jamal Uddin Choudhury, for correction of the name of his father in the order passed by this Court, dated 27.06.2024, passed in WP(C) No. 3268/2024 (since disposed of). 3. Mr. Choudhury, learned counsel for the applicant submits that in WP(C) No. 3268/2024, the name of the father of the applicant has been reflected as Rafique Uddin Laskar, but the same ought to have been Late Asaid Ali Choudhury, and as such, there is requirement for making necessary correction of the name of the father of the applicant in the order dated 27.06.2024, passed in WP(C) No. 3268/2024. Mr. Choudhury also submits that in support of his contention, the applicant has enclosed his Aadhaar Card by filing an additional affidavit today, and therefore, it is contended to allow this application. 4. Ms. Konwar, learned Standing counsel for the opposite parties also submits that she has no objection in view of the proof (Aadhaar Card) enclosed by the applicant in his additional affidavit filed today. 5. Having heard the submissions of learned Advocates of both sides, I have carefully gone through the application and the documents placed on record. 6. It appears that in WP(C) No. 3268/2024, the applicant has incorrectly mentioned the name of his father as Rafique Uddin Laskar, instead of which, it ought to have been Late Asaid Ali Choudhury. Annexure-A, page No. 16 of the additional affidavit filed by the applicant i.e. the Aadhaar Card also reveals that the name of the father of the applicant is Late Asaid Ali Choudhury. 7. In that view of the matter, this Court is inclined to allow this application.
Accordingly, it is provided that henceforth, the name of the father of the applicant/petitioner in the order dated 27.06.2024, passed in WP(C) No.
Page No.# 3/3 3268/2024, shall be read as Late Asaid Ali Choudhury in place of Rafique Uddin Laskar, for all purposes. 8. In terms of above, this I.A. stands disposed of. JUDGE Comparing Assistant
