The petitioner apprehending his arrest in connection with Bhandariya PS Case No. 5 of 2022 for the offences registered under Sections 353, 414 and 504 of the Indian Penal Code and under Section 7 of the Essential Commodities Act, has prayed for grant of anticipatory bail.

Learned counsel for the petitioner submits that the petitioner has committed no offence and he has been falsely implicated in this case. It has been submitted that in the FIR, there is no allegation that the alleged foodgrains were for black marketing and merely parking the alleged pick-up van inside the premises of petitioner will not constitute any offence as such, petitioner may be enlarged on anticipatory bail.

Learned APP opposes the prayer for grant of anticipatory bail to the petitioner.

Having heard learned counsel for the parties and considering the materials available on record, I am inclined to enlarge the petitioner on anticipatory bail and accordingly, the petitioner, above- named, in the event of his arrest or surrender before the Court below

within four weeks from today, shall be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Garhwa in connection with Bhandariya PS Case No. 5 of 2022, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023.
