Ajay Mohan Goel, Judge (Oral) By way of this petition, filed under Article 227 of the Constitution of India, Award dated 10.04.2021, passed by learned Lok Adalat, has been assailed by the State, inter alia, on the ground that there were other complaint’s also, who have not been made party to the compromise.
2. Having heard learned Additional Advocate General and learned counsel for the respondent, this Court is of the view that this is not a case which falls within the ambit of the 1Whether reporters of the local papers may be allowed to see the judgment?
2 2025:HHC:29751 guidelines laid by the Hon’ble Supreme Court of India, which enable the High Court to interfere with the Awards passed by the learned Lok Adalat, either under Article 226 or Article 227 of the Constitution of India.
3. It is not the case of the State that the Award passed by the learned Lok Adalat is a result of fraud or misrepresentation etc. or that the passing of the Award was not within the domain of the Lok Adalat.
4. In this view of the matter and more so, in light of the fact that none of the so called persons, whose cause is being espoused by the State, has approached the Court, this Court finds no reason to interfere with the Award passed by the learned Lok Adalat.
5. Accordingly, the petition is dismissed. Pending miscellaneous application(s), if any, also stand disposed of accordingly.
