THE HONOURABLE SRI JUSTICE HARINATH.N I.A.Nos.3 and 4 of 2025 IN/AND CRIMINAL PETITION No.4383 of 2025 COMMON ORDER: The instant petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short BNSS), has been filed by the petitioner/Accused No.1, seeking quashment of the proceedings against him in Crime No.402 of 2022 on the file of Kadapa Rural Police Station, YSR District, for the alleged offences under Sections 324, 323, 506 of IPC. 2. The learned counsel appearing for the petitioner submits that the other accused and the 2nd respondent in the present crime are compounded the offence and the crime against the other accused is quashed. Today, the petitioner/Accused No.1 and 2nd respondent/defacto complaint filed joint memo stating that they have entered into compromise and the 2nd respondent is not inclined to pursue the matter. 3. The learned Assistant Public Prosecutor for the state submits that, after receipt of wound certificate the police have altered the provision of law from Section 324 to Section 326 of IPC. It is further submitted that as many as eight cases are pending against the petitioner. 4. The learned counsel for the petitioner submitted that the other cases are petty cases for the offences under Sections 323 and 506 of IPC and etc., and that they cannot come in the way of compromise arrived between the petitioner and the 2nd respondent and it is purely private issue. 3
5. The de facto complainant filed I.A.Nos.3 and 4 of 2025, duly enclosing a Joint Memo entered between the petitioners as well as de facto complainant. It is stated that at the intervention of elders on both sides, the petitioners and the de facto complainant have arrived at an understanding and the matter has been settled between them. 4.
The learned counsel for the petitioner and learned counsel representing for the unofficial respondent No.2 (de facto-complainant) and learned Assistant Public Prosecutor representing the State are present. 5. Today, when the matter is taken up, petitioner/Accused No.1 and 2nd respondent herein are present before this Court. They produced their respective Aadhar cards in proof of their identity. Learned counsel for the petitioner and the learned counsel for 2nd respondent have identified the parties in the open Court. 6. This Court has questioned 2nd respondent herein/de facto complainant with regard to compromise, and she categorically stated to that extent that she has voluntarily entered into compromise with the petitioners herein/Accused No.1. This Court is satisfied with the identification of the parties and voluntariness in arriving at the compromise. 7. Since the parties entered into settlement and compromise, the Criminal Petition is allowed and therefore, the proceedings in Crime No.402 of 2022 on

the file of Kadapa Rural Police Station, YSR District against the petitioner herein/ Accused No.1 is hereby quashed. 8. Accordingly, I.A.Nos.3 and 4 of 2025 and Criminal Petition No.4383 of 2025 are allowed.
