learned counsel for the petitioners and learned Government Pleader for the respondents.

The claim of the petitioners is the petitioners herein were assigned the house sites by way of assignment vide Rc.No.A/64/2024, 14.02.2024 in Sy.No.650-2, Dharmavaram Village and Mandal, Sri Satya District. Pursuant to the subject assignments, the petitioners have been in possession and enjoyment of the respective house sites. While so, the 3'^'^ respondent herein has issued impugned notice vide Rc.No.283/G/2025, dated 08.04.2025 directing the petitioners to appear before him and submit the assignment
3 A pattas granted in favour of the petitioners and also to prove the eligibility of the petitioners for holding the subject assignment pattas granted in their favour.
Learned counsel for the petitioners submits that the issuance of the impugned notice after predetermination, to cancel the pattas issued in favour of the petitioners pursuant to the report submitted by the respondent herein on the ground that the petitioners are not eligible persons to hold the pattas in contrary to law is only an opinion of the 4^'^ respondent without observing principles of natural justice.

Learned counsel further submits that the 3'"^ respondent shall consider the issue as an adjudicating authority without relying upon the report of the 4 respondent, who himself concluded without issuing notice and without conducting any enquiry regarding the eligibility of the petitioners to hold the pattas in their favour. Aggrieved by the same, the petitioners filed the present Writ Petition. 5. th On the other hand, learned Government Pleader for Revenue submits that the impugned notice dated 08.04.2025 issued by the 3'"^ respondent is the process of enquiry and to determine the eligibility of the petitioners/patta If the petitioners and other patta holders prove their eligibility certainly, they would be confirmed as eligible persons and may continue the pattas in their favour. If the petitioners and other patta holders are determined as ineligible persons for holding the pattas, the respondents will follow due process of law in issuing further proceedings. 6. holders. 4 Considering the submissions of the learned counsel for the petitioners and the learned Government Pleader for Revenue and on perusal of the material available on record, this Court deems it appropriate to direct the petitioners to submit a detailed explanation along with the documents to prove their eligibility as well as the alienation said to have been made in favour of them within a period of two (02) weeks from the date of receipt of a copy of this Order. After such submission, the 3'"^ respondent is directed to consider the said explanation and pass orders by providing an opportunity of personal hearing to the petitioners and other stake holders, if any, within a period of two (02) months. Till such time, the respondents are directed not to interfere with the peaceful possession and enjoyment of the petitioners’ subject house sites. 7. 8. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Consequently, Miscellaneous Petitions, if any, pending in the writ petition shall stand closed.
