THIS PETITION, COMING ON FOR REPORTING SETTLEMENT, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner has sought for the following relief:- “Wherefore, the petitioner prays that this Hon’ble Court be pleased to call for the entire records to quash the entire proceedings in Crime No.52/2021 and in S.C.No.883/2022, for the alleged offences Punishable under section 143, 144, 148, 120(b), 307, 384 R/W 149 of IPC and Section 27 of Arms act at Bengaluru, pending before the LV Addl. City Civil and Sessions Judge (CCH-56), Bengaluru and grant such other relief/s as this Hon’ble Court deems fit to grant in the facts and circumstances of the case, in the interest of justice and equity.” 2. Learned counsel for the petitioner – accused, and learned counsel for respondent No.2 – complainant have filed a - 3 - NC: 2025:KHC:7955 CRL.P No. 1746 of 2025 Joint Affidavit duly signed by the petitioner, 2nd respondent and their respective counsel and the same is taken on record. 3. Petitioner – accused, respondent No.2 are physically present along with their respective counsel before the Court and they admit the contents of the Joint Affidavit which reads as under:- “JOINT AFFIDAVIT I Mr. M.Ravi, S/O. Muniyappa, aged about 47 years, R/a NO.9/2/78. 2ND floor, Maganahalli, Kodigehalli village and panchayat. Yeshwanthpura hobli, Bengaluru 560 055. The Petitioner (Accused No.6) in the above petition, now at Bengaluru do hereby solemnly affirm and state on oath as follows:- I Deepak S/O Rajanna, aged about 41 years, R/At No. 120, 2nd cross. Nanjappa block, B.T.Layout, Near Bhajane mane, K.G.Nagara, Bengaluru -560019, The Complainant / Respondent No.2 in the above petition, now at Bengaluru do hereby solemnly affirm and state on oath as follows:- 1. We state that, complaint came to be registered in Cr. No. 52/21 for the offence U/S 34, 307 of IPC and police have investigated the matter and filed the charge sheet for the offence U/S 143, 144, 148, 120(B), 307, 384 R/W 149 of IPC and 27 of Arms act in S.C.No.883/2022 pending on the file of Hon'ble LV Additional city civil and sessions judge (CCH-56), Bengaluru. - 4 - NC: 2025:KHC:7955 CRL.P No. 1746 of 2025 2. We state that, we are friends and known to each other for years and on the account of some misunderstanding a complaint came to be registered against the petitioner herein. 3. We state that, on the advice of elders, well wishers we do not want to prosecute the criminal case as we have amicably settle the dispute out of the court and in order to maintain cordial relationship and harmony we do not want to prosecute the criminal case in Cr. No. 52/21. which has been culminated in to criminal case in S.C.No.883/2022 WHEREFORE, we most humbly prayed that this Hon'ble court may kindly be permitted the parties to compound the offences punishable U/S 143, 144, 148, 120(B), 307, 384 R/W 149 of IPC and 27 of Arms act in S.C.No.883/2022, pending on the file of Hon'ble LV Additional city civil and sessions judge (CCH-56), Bengaluru by Kempegowda nagar Police and consequently quash the entire criminal proceedings in the interest of Justice and equity.” 4. In view of the aforesaid settlement entered into between the petitioner and 2nd respondent, I pass the following: ORDER (i) The petition is disposed of in terms of Joint Affidavit dated 20.02.2025. (ii) The proceedings in C.C.No.883/2022 (arising out of Crime No.52/2021 of 1st respondent – Police) registered for the - 5 - NC: 2025:KHC:7955 CRL.P No. 1746 of 2025 offences punishable under Sections 143, 144, 18, 120-B, 307, 384 r/w. 149 of IPC and Section 27 of the Arms Act, pending on the file of the LV Additional City Civil and Sessions Judge, insofar as the petitioner is concerned are hereby quashed.
