HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 8161 of 2025 Court No. - 6 HON'BLE PANKAJ BHATIA, J.
1. Heard, learned counsel for the petitioners and learned Standing Counsel.
2. The instructions filed by the learned learned Standing Counsel is taken on record.
3. The present petition has been filed by the petitioner challenging the order dated 09.05.2025, wherein, an order has been passed holding therein that the election held by the Committee of Management on 23.04.2025 and the papers submitted in respect thereof are forged, and consequently, the election held and presented through letter dated 24.04.2025 was set-aside. The contention of the
learned counsel for the petitioners is that, there was no dispute with regard to the elections of the Committee of Management by any of the members of the said Committee, however, the order has been passed solely on the ground that an observer was not present when the election was held, that the said issue, was decided by this Court vide judgment dated 14.08.2025 in Writ-C No.7013 of 2025, wherein it was held that the non-presence of an observer could not be fatal to the election in view of the Government Order issued in the year 2008. In view of the said judgment, the impugned order dated 09.05.2025 cannot be sustained and is liable to be quashed. It is also argued that the said view is fortified by the Government Order dated 27.10.2023, which itself records that where a Committee of Management has Versus Counsel for Petitioner(s) : Akash Dikshit Counsel for Respondent(s) : C.S.C. C/M City Intermediate College Thru. Manager Sardar Alok Singh And Another .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Deptt. Of Secondary Edu. Lko. And 3 Others .....Respondent(s)
been functioning without any dispute for a long time, there is no need for signature verification. Thus, on that account also, the impugned
order cannot be sustained.
4. The DIOS is directed to verify the signatures of the petitioners, as sought through the application dated 24.04.2025, within a period of three weeks from the date of presentation of a certified copy of this
order.
5. The petition stands allowed in terms of the said order. Consequent upon the passing of the order as directed above, the
order regarding the signature verification passed on 28.05.2025 shall automatically cease to have effect. September 1, 2025 Haseen U.
