1. Heard Sri Dhirendra Kumar Mishra, learned counsel for the applicant, Sri Anirrudh Kumar Vishkarma, learned Additional Government Advocate for the State and perused the records. 2. The instant application has been filed seeking release of the applicant on bail in Case Crime No. 449 of 2021, under Sections 120B, 471, 468, 467, 406, 420 and 419 of IPC, registered at Police Station Gomti Nagar Vistar, District Lucknow. 3. The aforesaid case has been registered on the basis of an F.I.R. lodged on 14.12.2021 against nine named persons, including the applicant and unknown persons, stating that the complainant had paid Rs. 25,00,000/- to Tribhuvan Singh Bora for purchasing a plot of land in numerous installments between 09.09.2021 and 20.01.2021 but no saledeed was executed in his favour. Thereafter, the accused persons obtained some further amount from the complainant in the name of transferring some other land and a saledeed was executed in favour of complainant's wife on 13.07.2021 but later it transpired that the land was disputed. 4. In the affidavit filed in support of the application it has been stated that the applicant is innocent, he has been falsely implicated in the present case. The applicant's involvement in another criminal case has been disclosed in paragraph 11 in the affidavit filed in support of the bail application, in which the applicant has already been granted bail. 5. Three co-accused persons have already been granted bail in the present case by this court and copies of the bail orders have been annexed as annexure no. 8 to the affidavit filed in support of the bail application. 6. The applicant has been implicated in the present case merely because he has witnessed the execution of the sale-deed in favour of the complainant's wife. 7. The learned Additional Government Advocate appearing on behalf of the State has opposed the prayer for bail and has submitted that the allegations have been established during investigation and the charge-sheet has been submitted. 8.
Having considered the aforesaid facts and circumstances of the case, and keeping in view the fact that the only allegation against the applicant is of having witnessed the execution of the sale-deed; that the applicant is languishing in jail since 24.09.2024, whereas the investigation stands concluded and three co-accused persons have already been granted bail, I am of the view that the applicant is also entitled to be released on bail. 9. Accordingly, this bail application stands allowed. 10. Let the applicant-Pramod Chandra Pandey @ Rohit Pandey be released on bail in the aforesaid case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of magistrate/court concerned, subject to following conditions:- (i) the applicant shall not tamper with the prosecution evidence; (ii) the applicant shall not pressurize the prosecution witnesses; (iii) the applicant shall appear on each and every date fixed by the trial court, unless his appearance is exempted by the learned trial court.
