The present bail application has been filed by the applicant apprehending his arrest in Case crime No. 205/2025, U/S-69, 51(3), 352 BNS, P.S.- Raunahi, District-Ayodhya/Faizabad. Heard learned counsel for the applicant as well as learned AGA for the State. Notice to respondent no. 2 is dispensed with in view of the proposed order. In the FIR, it has been alleged that for the first four years, the applicant, on the pretext of marriage, established physical relations with the victim. However, when the victim insisted on marriage, he refused. It is further alleged that the applicant’s brothers, namely Ajit and Manjeet, also abetted him in the commission of this offence. Learned AGA opposed the bail application, submitting that the applicant is not cooperating in the investigation, is absconding, and is presently residing in Punjab. A perusal of the statement of the victim under Section 180 BNS and 183 BNS shows that the statement of the victim are intact and she has fully supported the prosecution case. In view of the seriousness of the allegations, the consistent testimony of the Versus Counsel for Applicant(s) : Vijayendra Prakash Tripathi, Harsh Prakash Counsel for Opposite Party(s) : G.A. Ankit @ Ramjeet .....Applicant(s) State Of U.P. Thru. Prin. Secy. Deptt. Of Home Lko. And Another .....Opposite Party(s) victim, and the applicant’s non-cooperation in the investigation, no ground for granting anticipatory bail is made out.
