The present petition takes exception to the order dated 02.04.2024 passed by the learned Deputy Charity Commissioner, Jalgaon, on an application, at Exh. 78, in the Change Report No. 677 of 2022. On perusal of the prayer Clause at Exh. 78, it reveals that the petitioners who are the Objectors in the Change Report Proceedings prayed that the votes cast by the persons on the basis of authorization, may be discarded unless the authorizations are accompanied by disability certificates. The said application is rejected by the learned Deputy Charity Commissioner. 2 934wp4709.24 2. Learned Advocate for the petitioners states that the Returning Officer had sealed the votes cast in 7 different ballot boxes and in the 8th box the other record relating to the election process was kept. It is his contention that 7 boxes of the ballot papers were opened, however, the 8th box in which the other record pertaining the election process were kept was not opened. The learned Advocate for the contesting respondents/ the reporting trustees states that the 8th box was also opened. 3. The learned AGP, has taken instructions from the office of learned Deputy Charity Commissioner, Jalgaon and informs the Court that the 8th box containing other record pertaining to the election process is also opened. The learned Counsel for petitioner accepts the statement made by the learned AGP. The issue of validity of the votes casted on the basis of authorizations is kept open for the learned Deputy Charity Commissioner, Jalgaon to decide it at appropriate stage. With this, the Writ Petition is disposed of. 4. Since the Writ Petition is disposed of, the learned Deputy Charity Commissioner, Jalgaon is directed to proceed further with the adjudication of the change report proceedings. 5. On the joint request of the learned Advocates for the 3 934wp4709.24 parties, the learned Deputy Charity Commissioner, Jalgaon is requested to decide the change report proceedings on or before 30.09.2025, since the tenor of the Body is to expire in the month of October, 2025.
