Though having taken note of the fact that pursuant to order dated 28.10.2024, petitioner herein, who besides being Lecturer (Physics) is also Associate NCC Officer (Naval Wing), has already joined at GSSS Dhundan, there appears to be no reason for this Court to interfere with
order dated 28.10.2024, however, having taken note of the fact that petitioner is an Associate NCC Officer (Naval Wing) and in terms of instructions dated 20.2.2025 (Annexure P-19), Associate NCC Officer can only be posted in a School having NCC, this Court without going into the merits of the case deems it fit to dispose of the same with direction to the respondents to consider and decide representation dated 27.2.2025 (Annexure P-20), expeditiously preferably within three weeks. Ordered accordingly. Needless to say authority concerned while doing the needful shall afford an opportunity of hearing to the petitioner and pass detailed

speaking order thereupon, taking note of the notification dated 20.2.2025 as well as judgment dated 24.10.2024, passed by the Division Bench of this court in LPA No. 301 of 2024, Bhartendu Bhardwaj v. Union of India and Ors., wherein, it has been categorically held that Associate NCC Officer cannot be posted at Non-NCC School. Interim order stands vacated. Liberty is also reserved to the petitioner to file appropriate proceedings in appropriate court of law, if he still remains aggrieved.
