Heard learned counsel for the petitioners, learned Standing Counsel for the State Respondents and Sri Anurag Kumar Singh, learned counsel for the respondents no. 2 & 4. 2. This writ petition has been filed with the following main prayer:- "(i) A writ order or direction int he nature of Mandamus commanding the respondents to consider and allow the claim of the petitioners for removal of their names from the voter list and attendant records of Gram Panchayat Jamhaura Block and Tehsil Mitauli and inclusion of the electoral roll of village Bargadia (Bahera) Gram Panchayat Ibrahimpur, Block and Tehsil Mitauli, Thana-Nimgaon, District- Kheri and not to proceed further with the process of election in question, as notified vide Notification dated 11.07.2025, contained in Annexure 2, until the completion of the said exercise." 3. It has been submitted by learned counsel for the petitioners that the petitioners are originally residents of Gram Panchayat Ibrahimpur, Village Bargadiya, Tehsil Mitauli, Lakhimpur Kheri and their name should be included in the electoral roll for the territorial constituency of a Gram Panchayat. The petitioner also want their names to be struck off from the electoral roll of Gram Panchayat Jamhaura, Block and Tehsil Mitauli, Lakhimpur Kheri. They have moved an application in March, Versus Counsel for Petitioner(s) : Shivam Sharma Counsel for Respondent(s) : C.S.C., Anurag Kumar Singh Dushyant Shukla And Another .....Petitioner(s) State Of U.P. Thru. Addl. Chief Secy. /Prin. Secy. Panchayati Raj U.P. Lko. And 5 Others .....Respondent(s) 2025, but the respondents are not paying any heed and hence this writ petition has been filed. 4. Sri Anurag Kumar Singh, learned counsel appearing for the respondents no.2 & 4, on the basis of instructions, says that the process of amendments/revision of electoral rolls under the Panchayt Raj Adhiniyam by the State Election Commission has started on 18.07.2025 and will go on upto 29.09.2025 and petitioners have to make an appropriate application in prescribed form-2 and prescribed form-4. Prescribed form-2 is for inclusion of names in the electoral roll and prescribed form-4 is for striking off of the names from the electoral rolls. In fact two separate applications need to be filed under Rule 9 read with Rule 12 and Rule 10B read with Rule 12 of the U.P. Panchayat Raj (Registration of Electors) Rules, 1994, they may file the application online which shall be considered in accordance with rules and appropriate orders shall be passed thereon. 5. The written instructions are kept on record. 6. Accordingly, this writ petition is disposed of with a direction to the petitioners to approach the appropriate authority under the U.P. Panchayat Raj (Registration of Electors) Rules, 1994 as aforesaid within a week from today, If such an application is made in the prescribed form, the same shall be considered and disposed of before 29.09.2025.
