JUDGMENT AND ORDER (ORAL)
Heard Mr. A.H. Hazarika, learned counsel for the appellant. The appellant being aggrieved by the order dated 27. 08. 2025 passed by the learned single judge of this Court in WP(C) No. 87 of 2025 has now approached this Court with a prayer to set aside and quash the said impugned
order.
To understand the case of the parties, what is apparent is that the appellant as petitioner being aggrieved by the relevant authorities who has failed to carry out demarcation of his land as such, he has approached this Court for direction that the said demarcation be carried out.
From the impugned order what is also apparent is that the learned 2025:MLHC:958-DB
single judge has noticed that in course of the proceedings the authorities have carried out the demarcation of the land of the petitioner and has filed the report thereto.
Under such circumstances, it is the considered view of the learned single judge that the case of the petitioner no longer survives and the matter was disposed of accordingly.
We are made to understand that the appellant has approached this Court primarily being aggrieved by the contents of the said report filed before this Court. However, we are also of the view that as far as the initial prayer of the appellant is concerned, the same has been duly answered vide the impugned judgment and as such we find no merits in this appeal, the same is hereby dismissed. It is however, left open to the appellant to pursue his own course of action with the relevant authorities.
The appeal is disposed of. No costs.
