Mr. Lalit Samant, Advocate for the petitioner. 2. Mr. Narayan Dutt, Standing Counsel for the State of Uttarakhand. 3. Petitioner has challenged the order of transfer passed against her on 26.6.2023. By the said order, petitioner was transferred as Assistant Teacher, L.T. Grade from Government Higher Secondary School, Jhuni, District Pithoragarh to Government Inter College, Amori, District Champawat. 4. Learned counsel for the petitioner submits that petitioner has served at durgam places for nearly about 30 years, yet she was transferred to Amori, contrary to her option. 5. Learned State Counsel, however, submits that since Amori is categorised as ‘sugam’, therefore, in view of long services rendered by the petitioner at durgam place, she was transferred to Amori. 6. Learned counsel for petitioner submits that subsequent to passing of the impugned transfer order, a committee was constituted, which examined the matter and on the recommendation of the committee, petitioner was permitted to continue at Jhuni (Pihoragarh). He submits that now petitioner has served at durgam places 2025:UHC:10080 for more than 31 years, therefore, she may be permitted to make representation for her transfer to a sugam place. 7. The writ petition is, accordingly, disposed of with liberty to petitioner to make representation to the competent authority, for her transfer. If she makes representation within two weeks from today, the competent authority shall look into the matter and take appropriate decision, as per law, within six weeks thereafter. For a period of eight weeks or till decision is taken, whichever is earlier, status quo as regards petitioner’s posting shall be maintained.
