Applicant Sumer Kaushik, who is in judicial custody in connection with FIR/Case Crime No. 258 of 2025, under Sections 2 & 3 of the U.P. Gangsters & Anti Social Activities (Prevention) Act, 1986, registered at P.S. ITI, District Udham Singh Nagar, has sought his release on bail. 2. Heard learned counsel for the parties and perused the records. 3. Learned counsel for the applicant would submit that the applicant is innocent and he has been falsely implicated in the case; that the applicant has a criminal history of seven cases including the present one, 2025:UHC:10186 2 and in the remaining six cases he has either been granted bail or final reports have been submitted. 4. Learned State Counsel does not deny this fact. 5. Having considered the matter, and in view of the facts and circumstances of the case, particularly the fact that in all the six other cases registered against the applicant he has either been granted bail or final reports have been submitted, this Court is of the opinion that the present case is fit for bail and that the applicant deserves to be enlarged on bail. 6. Accordingly, the bail application is allowed. 7. Let the applicant be released on bail on his executing a personal bond and furnishing two reliable sureties each of the like amount, to the satisfaction of the court concerned.
