The aforesaid case has been registered on the basis of an F.I.R. lodged on 29.09.2024 against four persons, including the applicant, stating that the complainant wanted to purchase a plot of land for which she contacted co- accused Ankit Yadav. Ankit Yadav introduced her to the other co-accused persons and the complainant had entered into a deal to purchase a plot measuring 1500 sq. ft. from Sagarcity Infratech Pvt. Ltd. On the submission of the complainant four other ladies had paid money for taking plots. When the purchasers demanded execution of transfer deeds, notarized documents were executed on 23.10.2023 but no sale deed was got registered. 4. In the affidavit filed in support of the bail application, it has been stated that the applicant is innocent, he has been falsely implicated in the present case and he has no previous criminal history. 5. The learned counsel for the applicant has submitted that the applicant had acted merely a broker and he does not hold any position in Sagarcity Infratech Pvt. Ltd.
6. Learned AGA has opposed the bail application and he has submitted that the allegations have been established during investigation and a charge sheet has been submitted on 18.08.2025 against the applicant and two other accused persons. He has further submitted that it has come to light during
investigation that the purchaser had transferred money to the applicant's bank account through online mode. 7.
Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that the allegations levelled in the FIR do not disclose that any registered agreement for purchasing the property was entered into; the FIR does not disclose the total agreed sale consideration and whether the entire sale consideration has been paid or not and that the applicant claims that he does not hold any position in Sagarcity Infratech Pvt. Ltd., that the applicant has no previous criminal history and he is languishing in jail since 24.06.2025 whereas the investigation already stands concluded, I am of the view that the aforesaid facts are sufficient for making out a case for enlargement of the applicant on bail. 8.
