The present contempt application has been preferred for alleged non compliance of the judgment and order dated 27.09.2024 passed in Matters Under Article 227 No. 4579 of 2024. The relevant para of the same is quoted hereinunder:-
"4. In view of the aforesaid facts, this petition is disposed of by issuing a direction to the learned Special Judge, P.C. Act, Court No.4, Lucknow to decide Rent Appeal No.47 of 2023 expeditiously, in accordance with law, without granting any unnecessary adjournment to any of the parties." Learned counsel for the applicant has submitted that the copy of the judgment and order was served on 10.10.2024 but till date, the matter has not been decided despite there is a direction for deciding the rent appeal expeditiously. From perusal of the order sheet, it is found that the matter was listed regularly and on few dates, the matter was adjourned on the joint request of learned counsel for the respectively parties including the present applicant on the ground that talks are going on for compromise. On few dates, learned counsel for both the parties including the applicant did not appear. On one date, the counsel for the present applicant, who is respondent in the appeal was not present and learned counsel for the applicant is unable to dispute that the applications moved by the applicant for which time was granted for filing objection is permissible under the law, so this Court does not find any reason for granting any unnecessary adjournment to any of the parties and the writ Court by its judgment dated 27.09.2024 has issued direction for expeditious disposal of the rent appeal, in accordance with law, without granting any unnecessary adjournment to any of the parties, the applicant has failed to show that the Court was granting any unnecessary adjournment to any of the parties.
