Neutral Citation No. - 2025:AHC-LKO:49286 Court No. - 17 Case :- MATTERS UNDER ARTICLE 227 No. - 4961 of 2025 Petitioner :- Harpal Singh Respondent :- State Of U.P. Thru. Prin. Secy. Urban Development Deptt. Lko. And 3 Others Counsel for Petitioner :- Vijyant Nigam,Ashish Agarwal Counsel for Respondent :- C.S.C. Hon'ble Manish Kumar,J. Heard. The present writ petition has been filed by the petitioner with the following main prayer :
"Issue appropriate directions to the Chief Judicial Magistrate Behraich/ Respondent No.2 to expeditiously hear and dispose of the Appeal No.07/2008 Re: Harcharan Singh and another Versus Nagar Palika and another pending before the learned Chief Judicial Magistrate Behraich, preferably within a period of 30 days."
Learned counsel for the petitioner has submitted that an appeal bearing Appeal No.7 of 2008 under Section 160 of Municipal Corporation Act has been filed by respondent nos.3 and 4 in which the petitioner is a respondent. The court concerned is granting general dates instead of deciding the appeal, which is pending for more than 15 years. After hearing learned counsel for the petitioner and going through the records, particularly the
order sheets from 15.12.2022 to 14.07.2025 i.e. out of 52 dates, it is noticed that on more than 45 occasions, general dates have been given by the court concerned instead of proceeding with the matter. Looking to the long pendency of the appeal since the year 2008 and the fact that for most of the time, only general dates have been given by the court concerned as noted above, it is directed that
the court concerned shall decide the appeal within a period of six months, after giving opportunity of hearing to the parties, without granting any unnecessary adjournment to either of the parties and if any adjournment is unavoidable, only short dates may be fixed. Without entering into the merits of the case, the writ petition is disposed of.
