1. Heard Sri Manoj Kumar Singh, the learned counsel for the applicant as well as Sri Virendra Kumar, the learned A.G.A.-I for the State and perused the records. 2. The instant application has been filed seeking release of the applicant on bail in Case Crime No. 888/2021, under Sections 409, 420, 467, 468, 471, 120-B, 504, 506 IPC, Police Station Gomti Nagar, District Lucknow. 3. The aforesaid case has been registered on the basis of an F.I.R. lodged on 12.11.2021 against five persons, not including the applicant, stating that the informant had made investment in Shine City Infra Project Pvt. Ltd. and it was promised that he will be transferred a developed plot of land but no benefit was given to the informant on the investment. 4. In the affidavit filed in support of the bail application, it has been stated that the applicant is innocent, he has been falsely implicated in the present case because he used to work as an agent for the company. 5. The learned AGA-I has opposed the prayer for bail and he has submitted that the allegations have been established during investigation and a charge sheet has been prepared and it will be submitted in the court very soon. He has submitted that the applicant is involved in six other cases, although all of the cases are similar in nature. 6. Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that the FIR alleges non- return of benefits in respect of the investment made in a company; the applicant was merely working as an agent in the company and he was neither director nor any principal position holder in the company, coupled with the fact that the applicant
is languishing in jail since 23.07.2025 whereas the investigation already stands concluded, I am of the view that the applicant is entitled to be released on bail. 7. Accordingly, this bail application stands allowed. 8.
