As could be seen from the above, the plan that had been approved in favour of the petitioner to construct his building has been suspended in light of the suit filed by one Jayamma and others in O.S. No.503 of 2022. The Tumkuru Mahanagara Palike has basically come to the conclusion that until the dispute regarding the title of the property was decided, no decision could be taken on the plan sanctioned. 3. The petitioner has also produced a copy of the plaint filed by Jayamma and others in O.S. No.503 of 2022. Paragraph No.4 of the said plaint reads as follows: "4. The defendant is the utter stranger to suit schedule property who is not having any right title or possession over the schedule property and there is no piece of documents stands in the name of defendant who is nothing to do with the suit schedule property. It submitted that, the defendant is - 5 - NC: 2025:KHC:6353 WP No. 4675 of 2024 having a property on southern side of the suit schedule property, but now the defendant is trying to interfere into peaceful possession and enjoyment of plaintiffs in schedule property. The defendant also illegally trying to constructing the structure in his property without obtaining any license from the concerned authorities by trying to encroach the schedule property on southern side, hence the act of defendant is against to law." (emphasis supplied) 4. As could be seen from the above averment of Jayamma herself, she admits that the petitioner was putting up a construction in her property. She however contends that it is being done without obtaining any license. 5. In fact, even in the suit schedule, she has indicated that the petitioner owns the property to the south of her property and her only grievance was that the petitioner was trying to interfere with her possession over her property. It is obvious that - 6 - NC: 2025:KHC:6353 WP No. 4675 of 2024 Jayamma did not have any claim over the petitioner's property. 6. In that view of the matter, the impugned endorsement cannot be sustained and the same is hereby quashed. 7. The order of the Tumkuru Mahanagara Palike to keep the approval granted to the petitioner in abeyance shall also stand accordingly quashed. 8. The writ petition is accordingly disposed of.
