In the instant case, it is brought to my notice that the respondent / employee has retired from service and the total outstanding amount in favour of the respondent is near about Rs.50,000/-. 3. In the complaint the industrial court has observed that the bus driver Shri S. S. Patil and conductor Shri S. I. Patil, who were allegedly obstructed from performing duties, have not been examined. No other witness has been examined to show that the complainant by participating in the strike obstructed the bus drivers and conductors and the buses. 2025:BHC-AUG:27581 2 wp5168.2025 The Industrial Court held that there is no evidence indicating that the complainant has committed misconduct, although, opportunity was given, the respondent failed to prove and that the punishment is imposed on the employee without their being any evidence. 4. The petitioner has not been able to demonstrate before this court any substantial evidence to reverse the finding given by the Industrial Court. 5.
