And 4 Others Counsel for Petitioner :- Ajay Pratap Singh Counsel for Respondent :- C.S.C., Atul Kumar Dwivedi, Lalit Shukla Hon'ble Pankaj Bhatia,J.
1. Heard the counsel for the parties.
2. The present petition has been filed by the petitioner challenging the decision dated 07.04.2025 whereby the request of the petitioner for grant of affiliation has been rejected. The said order has been passed based upon the recommendation of the affiliation committee who were of the opinion that the land bearing Gata No.608 did not belong to the petitioner.
3. The contention of the counsel for the petitioner is that the foundation of the said order, is erroneous inasmuch as subsequently, the Board of Revenue vide its
judgment dated 28.07.2025 has passed an order in favour of the petitioner in respect of the land bearing Gata No.608.
4. As the order is based upon the report of the affiliation committee which finds that the petitioner are not the owner of the land in question and an order has been passed in favour of the petitioner as argued, the impugned order dated 07.04.2025 as well as the consequential order dated 09.04.2025 are quashed. The matter is remanded to the respondent no.3 to pass a fresh order taking into account the order of the Board of Revenue.
5. As the last date with regard to new affiliation is going to end today (14.08.2025), the respondent no.3 is directed to take a decision, if possible by 8:00 pm today keeping in view the judgment of the Board of Revenue. The petitioner shall approach along with a copy of this order before the respondents no.3 and 4.
6. The counsel for the respondents shall also inform the respondents no. 3 & 4 about this order.
