The award also stipulates the payment of full backwages. 2. Learned counsel appearing for the petitioner and the learned counsel for the respondent are present. The authorised signatory on behalf of the petitioner and the respondent are present. 3. Joint memo is filed reporting settlement. Joint memo is signed by the authorised signatory on behalf of the petitioner and also by the respondent. 4. The terms of the settlement read as under: (1) The petitioner's management has agreed to pay a consolidated sum of Rs.5.00 lakh (Rupees five lakh only) as - 3 - NC: 2025:KHC:4807 WP No. 4969 of 2014 ex-gratia in full and final settlement including statutory benefits such as PF, Gratuity etc. (2) Both the parties agreed to file Joint Memo of Settlement and seek for modification of the Award impugned terms of the Joint Memo of Settlement. (3) This payment is in full and final settlement of all the claims. Respondent declares that he has no other claim whatsoever against the petitioner's company which is inclusive of reinstatement. (4) It is agreed that the above ex-gratia amount will be paid to the respondent in the Court hall after reporting the settlement. 5. On enquiry, parties submit that they have voluntarily entered into settlement. Respondent who is present before the Court acknowledges the receipt of the Demand Draft for the amount specified in the joint memo. 6.
