Neutral Citation No. - 2025:AHC-LKO:49460-DB Court No. - 2 Case :- WRIT - C No. - 8064 of 2025 Petitioner :- Sunil Kumar Respondent :- State Of U.P. Thru. Prin. Secy. Revenue Deptt. Lko. And 6 Others Counsel for Petitioner :- Vinod Mishra,Antriksh Verma Counsel for Respondent :- C.S.C.,Mohan Singh Hon'ble Mrs. Sangeeta Chandra,J. Hon'ble Brij Raj Singh,J. 1. Heard learned counsel for the petitioner and learned Standing Counsel, who appears on behalf of State-respondents. 2. This petition has been filed with the following prayers :- "I. Issue a writ order or direction in the nature of mandamus the opposite parties not to construct the 'Police Chauki' before the Sehan land of the petitioner situated at Gata No.206/0.2460 Hectare of Village - Rampur, Pargana- Meeranpur, Tehsil- Sadar, District- Sultanpur, in the interest of justice. II. Issue a writ order or direction in the nature mandamus directing the opposite parties to look into the matter and take appropriate action regarding the grievance of the petitioner as raised in application dated 02.08.2025 moved by petitioner (Annexure No.9 to this writ petition) in the interest of justice." 3. It has been submitted by learned counsel for the petitioner that the Gram Pradhan is inimical to the petitioner and has requested the police authorities to construct a 'Police Chauki' in front of the petitioner's Sehan. 4. It has further been submitted that the petitioner has moved an I.G.R.S. complaint, on which a report has been submitted by the police, a copy of which has been filed as Annexure-10 to the writ petition. 5. We have perused Annexure-10 to the petition, which is a report in respect of the petitioner's I.G.R.S. complaint submitted by the In-charge Inspector, Police Station Bandhua Kala, District Sultanpur. From the same, it is evident that the petitioner's house is constructed on abadi land, Gata No. 206, of which he is in possession of 3 biswa land. Adjacent to his house, a Gram Sabha road/kharanja marg has been laid, linking it to the main road. There is also one temple near the petitioner's house, in which installation of a Devi Durga idol was proposed by the Gram Pradhan, but the petitioner raised serious objections. 6. The In-charge Inspector of Police Station Bandhua Kala, Sultanpur, visited the site and brokered peace between the parties. The petitioner had placed some garbage in front of the temple, which he removed after the settlement was reached. However, there was a breach of peace again on 07.10.2024 and proceedings were initiated under Sections 126/135 of the B.N.S.S. 7. Learned counsel for the petitioner has referred during the course of arguments (which we have perused) that the petitioner is not aggrieved by the 'Police Chauki' being constructed in his Sehan. Rather, he is aggrieved by the Police Chauki being constructed near the Chak Marg/link road to the main road. 8. If the petitioner is aggrieved, he may approach the competent Civil Court. 9. With the aforesaid observations, the writ petition stands disposed of. (Brij Raj Singh, J.) (Sangeeta Chandra, J.)
