Neutral Citation No. - 2025:AHC-LKO:49271 Court No. - 17
Case :- MATTERS UNDER ARTICLE 227 No. - 4954 of 2025
Petitioner :- Shivang Vikram Singh Respondent :- Court Of Civil Judge (Senior Division) Court No 15 Dist. Sultanpur And 9 Others Counsel for Petitioner :- Umesh Pratap Singh,Anju Tripathi
Hon'ble Manish Kumar,J.
1. The present writ petition under Article 227 of the Constitution of India has been preferred with the following main prayer:-
" WHEREFORE, it is most respectfully prayed that this Hon'ble Court may kindly be pleased to direct the Opp. Party no.1/ Civil Judge (Senior Division), Court No.15, Sultanpur to consider and decide the Suit No.818/2019 Pratima vs Kaushalendra& Others, expediously (Annexure No.1), as decided by this Hon'ble Court."
2. Learned counsel for the petitioner has submitted that a regular suit for permanent injunction has been filed by Ms. Pratima Singh, i.e. respondent no. 2 in the present petition and the defendant/respondent in the regular suit, which is pending since the year 2019, but till date, even the issues have not been framed. 3. After hearing learned counsel for the petitioner and going through the records of the case, particularly the ordersheets alongwith the paper book, which reveals that since the year 2019 till 2023, the amendment was allowed, thereafter, the injunction application was rejected by order dated 31.10.2023 and the case was fixed for framing of issues. Thereafter, on several dates, none of the parties including the present petitioner, who is the respondent/defendant in the suit, was present and on one date, the Advocates were abstaining from work. Under these circumstances, it is not a fit case to issue any direction for disposal of the suit within a fixed time frame. 4. On being asked from learned counsel for the petitioner whether he has moved any urgency application before the court concerned for early disposal of the suit or not, he has very fairly submitted that no such application has been preferred till date. 5. The present petition is disposed of with liberty to the petitioner to move an appropriate application before the court concerned for early disposal of the suit, which is pending since the year 2019.
In case, any such application is preferred, it is expected that endeavour shall be made by Court concerned to decide the same, expeditiously, in accordance with law, if there is no other legal impediment, without granting any unnecessary adjournment to either of the parties and if any adjournment is sought by either of the parties, only short
dates may be fixed. Order Date :- 22.8.2025 DiVYa A227 No. 4954 of 2025 2 Digitally signed by :- DIVYA SINGH High Court of Judicature at Allahabad, Lucknow Bench
