(Oral) By means of the instant application, the applicant seeks transfer of Miscellaneous Criminal Case No. 192 of 2024, Bhawna @ Manju v. Jagdish Chandra Bhatt, under Section 125 of the Code of Criminal Procedure, 1973 (“the case”) from the court of Judge, Family Court, Haldwani, District Nainital to the court of Judge, Family Court, Rudrapur, District Udham Singh Nagar. 2. Heard learned counsel for the parties and perused the record. 3. The applicant is husband of the respondent. A matrimonial dispute arose between them. The applicant has filed a suit for annulment of marriage in the court of Judge, Family Court, Rudrapur being Matrimonial Case No. 72 of 2024, Jagdish Chandra v. Bhawna @ Anju (“matrimonial case”). Today, the said matrimonial case filed by the respondent has been transferred from the Rudrapur court to the Haldwani Court. 4. Learned counsel for the applicant submits that both the cases may be heard at one place. 2 5. Since the matrimonial case filed by the applicant, pending in the court of Family Judge, Rudrapur has already been transferred to the Family Court, Haldwani, by an order passed today in C-24 No. 52 of 2024, Anju @ Bhawana v. Jagdish Chandra Bhatt, there is no reason to transfer the case to Rudrapur court. Accordingly, the transfer application deserves to be dismissed. 6. The transfer application is dismissed.
