Mr. Shivam Gulati, learned counsel for the applicant. 2. Mr. Dinesh Chauhan, learned AGA along with Mr. Jay Prakash, learned Brief Holder for the State. 3. Applicant Satyam, who is in judicial custody in connection with Case Crime/ FIR No. 525 of 2025, under Sections 109 (1) of BNS, registered at P.S. Kotwali Haridwar, District Haridwar, has sought his release on bail. 4. Heard learned counsel for the parties and perused the record. 5. As per the prosecution story, an FIR was lodged by the complainant-Smt. Rani Chauhan W/ o Shamsher Singh, alleging that her son, Shubh Chauhan (aged 19 years), went out for a walk on 24.07.2025 at about 8: 30 PM and did not return home. On the following day, 25.07.2025, she received information from the Government Hospital, Haridwar, that her son had been admitted with serious injuries. It is further alleged that upon regaining consciousness, Shubh Chauhan stated that while he was at the Moti Chur Jungle overpass with two friends, the accused Satyam Jaat and Noman arrived in a vehicle, threatened him, and pushed him off the overpass, resulting in grievous injuries. 6. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated; that, the applicant, along with his friend, was merely passing over the Moti Chur Jungle 2025:UHC:10830 overpass when a group of 6–7 boys arrived and began quarrelling and assaulting them. In the course of this scuffle, the police came, the complainant’s son while running away from the police, fell into a dried-up river channel, and sustained injuries. Due to the intervention of the police, the said boys fled from the spot. 7. Learned counsel for the applicant has further submitted that they have also filed a complaint regarding assault upon them, but, no action has been taken by the police. Learned counsel for the applicant also points out that the co-accused Noman has already been granted bail by the Sessions Judge, Haridwar; that, the applicant is a student of Class 12, aged about 18 years, and his examinations are scheduled to commence from 16.12.2025. 8. Learned State Counsel has vehemently opposed the bail application. 9. In view of the above, but, without expressing any opinion about merits of the case before the Trial Court, this Court is of the view that this is a fit case for bail. 10. The bail application is thus, allowed and the applicant is directed to be released on bail on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the Court concerned.
