In my view, having regard to the fact that the petitioner has lost his opportunity to argue the revision petition on merits, it would be appropriate to set aside the order of the Deputy Commissioner and remand the matter to the Deputy Commissioner with a direction to him to consider the revision petition - 3 - NC: 2025:KHC:13135 WP No. 28746 of 2017 filed by the petitioner on merits after hearing both the parties. 3. The writ petition is accordingly allowed. 4.
