IN THE HIGH COURT OF HIMACHAL PRADESH, SHIMLA CWP No.8953 of 2025 Date of Decision: 04.06.2025 _____________________________________________________________________ Anil Kumar ……...Petitioner Versus State of Himachal Pradesh & Ors. …....Respondents Coram Hon’ble Mr. Justice Sandeep Sharma, Judge. Whether approved for reporting? For the Petitioner: Mr. Manohar Lal Sharma, Advocate. For the respondents: Mr. Anup Rattan, Advocate General, Mr. Rajan Kahol, Mr. Vishal Panwar & Mr. B.C. Verma, Additional Advocate Generals with Mr. Ravi Chauhan, Deputy Advocate General. ___________________________________________________________________________ Sandeep Sharma, J. (Oral) Petitioner herein, who at present is working as Lecturer (Economics) at Government Senior Secondary School Mahadev, Tehsil Khundian, District Kangra, Himachal Pradesh, has approached this Court in the instant proceedings, seeking therein direction to the respondents to relieve him from present place of posting in terms of impugned transfer order dated 30.04.2025 (Annexure P-1), whereby he has been transferred from afore station to Government Senior Secondary School Daroh. 2. Having taken note of the case of the petitioner, as detailed hereinabove, this Court specifically called upon learned Additional Advocate General, vide order dated 29.05.2025, to have instructions that why petitioner is not being relieved, despite his having been transferred from present place of posting to Government Senior Secondary School Daroh, District Kangra, Himachal Pradesh, but till date, neither reply has been filed nor instructions has been placed on record. 3. Since on account of delay on the part of the respondents in relieving the petitioner, pursuant to transfer order, there is state of confusion, especially for the petitioner, coupled with the fact that till date, no order, if any, in supersession of transfer order dated 30.04.2025 (Annexure P-1) has been placed on record by the learned Additional Advocate General, this Court deems it fit to allow the present petition with a direction to the respondents to ensure that petitioner, in terms of impugned transfer order dated 30.04.2025, is relieved forthwith, enabling him to join at transferred station. Pending applications, if any, stand disposed of. June 04, 2025 (Sandeep Sharma), (sunil) Judge 2
