Heard Sri Sushil Kumar Yadav, learned counsel for the petitioner, Sri Arun Kumar Pandey, learned A.G.A. for the State-respondents, Sri Pramod Kumar, learned counsel for the respondent no. 4 and perused the material placed on record. 2. By means of this writ petition, the petitioner has assailed the impugned FIR dated 04.08.2025 registered as Case Crime No. 0328 of 2025, under Sections 87, 137(2), 351(3) BNS, Police Station Lambhua, District Sultanpur. 3. Learned A.G.A. has produced the copy of instruction letter dated 21.08.2025 provided by Dharmendra Kumar Mishra, Inspector, Police Station Lambhua, District Sultanpur, addressing to the Government Advocate of this Court, the same is taken on record. 4. As per the aforesaid instruction, during the course of investigation Sections 65(1) BNS and 5/6 POCSO Act have been added and the location of the accused persons is being searched. On that, learned counsel for the petitioner has requested that he may be permitted to withdraw the present petition at this stage and liberty may be given to file anticipatory bail application before the competent Court of law. 5. Having considering the aforesaid, the present petition is dismissed being withdrawn . However, it is always open for the petitioner to file anticipatory bail application before the competent Court of law. If such anticipatory bail application is filed, the same may be decided on its merit.
