Heard learned Counsel for the petitioner and learned Standing Counsel. 2. The present writ petition has been filed by the petitioners challenging an order dated 17.07.2025 passed by the DIOS, Raebareli wherein the papers submitted by the petitioners for election have been rejected solely on the ground that no observer was appointed for overlooking the election as held by the petitioners. 3. The neat contention of the Counsel for the petitioners is that the said reasoning is contrary to the mandate of the Government Order dated 27.10.2023 (Annexure-9). 4. Considering the mandate as contained in para 2 of the Government Order dated 27.10.2023, the non-presence of the observer ipso facto would render the entire election void. 5. Considering the fact that the impugned order has been passed solely on the ground that there was no observer, the same cannot be sustained. The order dated 17.07.2025 is quashed. The writ petition is allowed. 6. The matter is remanded to the DIOS, Raebareli to pass fresh order taking into consideration the mandate of Government Order dated 27.10.2023 within a period of four weeks from the date of presentation of a certified copy of this order and in accordance with law.
