ORDER (03.01.2025)
(ORAL)
01. Impugned in this petition filed under Article 226 of the Constitution of India is an interim order dated 10.12.2024 passed by the learned Central Administrative Tribunal, Jammu [“the Tribunal”] in OA No. 1348/2024 along with OA No. 1111/2024 titled “Munshi Ram vs Rural Development Department”, whereby the Tribunal has, while issuing notice to the S. No. 17
2 WP(C) No. 48/2025
respondents to file objections, also directed to consider the case of the applicant-Munshi Ram for promotion and has granted status quo with regard to the promotion of private respondents 6, 7 and 8 till further orders. The order impugned is interim in nature and subject to variation/vacation on motion by the petitioners herein. Ordinarily this Court does not interfere with such interim orders for the reason that the same are ad-interim and subject to variation. However, in the interest of justice and with a view to maintain equity between the parties, we modify the order and provide that till the application for interim relief is considered by the Tribunal after objections are filed by the respondents 6, 7 and 8, there shall be status quo with regard to promotion of the applicant as well as respondents 6 to 8.
02. Disposed of.
03. CAV No. 2435/2024 shall also stand discharged.
