HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 7994 of 2025 Court No. - 2 HON'BLE MRS. SANGEETA CHANDRA, J.
HON'BLE BRIJ RAJ SINGH, J.
1. Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
2. In view of the order proposed to be passed, issuance of notice to respondent nos.4 to 7 is dispensed with.
3. This petition has been filed by the petitioner with following main prayers:-
"(i) Issue a writ, order or direction in the nature of Mandamus thereby directing the opposite parties no.2 and 3 to take appropriate action on the application moved by the petitioner, as contained in Annexure No.1 to the writ petition, in the interest of justice."
4. We have gone through the representation/application of the petitioner, copy of which has been filed as Annexure-1 to the writ petition. It appears that respondent nos.4 to 7 are interfering in the peaceful possession of the petitioner over the property that has been bought by him through registered sale deed on 19.12.1989. The appropriate remedy for the petitioner would be to file a suit for permanent injunction. The prayer for the respondents to consider the application of petitioner on administrative side, if granted, would confer jurisdiction on the officers, which is not permissible.
