This appeal is directed against the order dated 03.07.2025 passed in Writ A No.9485 of 2024, whereby challenge laid by the appellant to his order of transfer dated 01.10.2024 and 04.10.2024, has been dismissed. 2. The appellant was under suspension and on reinstatement, order was passed posting him at Nagar Nigam, Gorakhpur whereafter another order was passed transferring him from Nagar Nigam, Gorakhpur to Nagar Nigam, Varanasi. 3. Feeling aggrieved, the petition was filed. 4. The challenge laid was principally on the ground that order has been passed by an incompetent authority as the same was signed by Under Secretary of the department. 5. Learned Single Judge after hearing the parties came to the conclusion that as the Secretary as defined under Uttar Pradesh Adhipramanikaran (Aadesh Aur Anya Likhit) Niyamawali, 1975, includes the Under Secretary, there was no illegality in the order passed and that the order was passed after seeking approval from the competent authority and consequently dismissed the writ petition. 6. Feeling aggrieved, the present appeal has been filed. 7. When the matter came up before this Court, the respondents were directed to produce the record, whereby the appellant was transferred. Pursuant to the directions, record has been produced for perusal of the Court. 8. A perusal of the record indicates that the note sheet initiated by the Under Secretary was duly approved by the Principal Secretary and the concerned Minister, which reads as under: "कक पयया पतयावलली कके गत पकष -8 पर प्रममुख सचचिव महहोदय अंचकत आदकेशशों एवअं तदक्रम मम मया० मअंतली जली दयारया प्रदयान चकयके गयके अनमुमहोदन कके क्रम मम शयासन कके कयाययार्यालय जयाप सअंख्यया-3117 /नन-4-24-01 ई०ओ०/2024, चदनयाअंक 01.10.2024 दयारया चनलअंबन सके बहयालली कके उपरयान्त शली रयाजलीव कमु मयार चिनधरली , लकेखयाधधकयारली कहो नगर चनगम, गहोरखपमुर मम तयात्कयाधलक प्रभयाव सके ततैनयात चकयया गयया। सअंजयान मम आयया हतै चक नगर चनगम , गहोरखपमुर मम लकेखयाधधकयारली कके पद पर चवत्त एवअं लकेखया सकेवया कके शली रचव धसअंह पपूवर्या सके हली ततैनयात हह। अततः नगर चनगम , गहोरखपमुर मम लकेखयाधधकयारली कया पद ररक्त नहहीं हतै। 2- अततः उपरहोक्त कके दृचष्टिगत लकेखयाधधकयारली , शली रयाजलीव कमु मयार चिनधरली सम्बद चनदकेशक, नगरलीय चनकयाय चनदकेशयालय, उ०प्र०, लखनऊ कया कयाययार्यालय जयाप सअंख्यया-3117 /नन-4-24-01 ई०ओ०/2024, चदनयाअंक 01.10.2024 दयारया नगर चनगम, गहोरखपमुर मम चकयया गयया स्थयानयान्तरण तयात्कयाधलक प्रभयाव सके व्ययावचतर्यात करतके हहयके इन्हम नगर चनगम , वयारयाणसली मम लकेखयाधधकयारली कके ररक्त पद पर ततैनयात चकयके जयानके पर चवचियार चकयया जयानया प्रस्तयाचवत हतै। कक पयया सहमचत ककी दशया मम प्रस्तमुत प्रस्तयाव पर प्रममुख सचचिव महहोदय कके मयाध्यम सके मया० मअंतली जली कया अनमुमहोदन प्रयाप्त करतके हहयके प्रस्तमुत आलकेख अनमुमहोचदत करनया चियाहम।" 9. It is apparent from the above that insofar as the transfer in question is concerned, the same has been made on account of the fact that the post at Gorakhpur was already filled up and therefore, on the transfer proposal, approval has been granted by the Principal Secretary and the concerned Minister. 10. Attempt was made to make submissions that the proposal should have initiated by the Principal Secretary. We do not find any substance in the submission as the proposal has been made by the Under Secretary and had appropriately been approved by the Principal Secretary and the concerned Minister. 11. In that view of the matter, there is no substance in the appeal, the same is, therefore, dismissed.
