Instant writ petition under Article 227 of the Constitution of India has been filed raising a challenge to the part of the order dated 16.07.2025 whereby the learned trial Court has issued notice on the application under Order 39 Rule 1 & 2 of the Code of Civil Procedure in Regular Suit No. 298 of 2025 that has been filed by the petitioner herein/plaintiff. Learned counsel for the petitioner has expressed urgency in the matter. Taking into consideration the aforesaid, the present petition is disposed of with a direction to the learned trial Court to pass orders on the aforesaid application on the next date fixed or within a period of next six weeks in accordance with law provided there is no legal impediment.
