(Oral) Petitioner herein, who at present is working as Lecturer at Government Senior Secondary School Badhal, District Shimla, Himachal Pradesh, has approached this Court in the instant proceedings, seeking therein direction to the respondents to consider and decide his pending representation (Annexure P-3), whereby he has prayed for his transfer from present place of posting in terms of Clause 5.4 of Transfer Policy, which enables an employee to seek transfer on account of couple case. 2. It has been averred in the petition that since wife of the petitioner is working in Government Primary School Kalpa, District Kinnaur, Himachal Pradesh, petitioner may also be transferred to afore station so that family life of both the petitioner and his wife does not get disturbed. 3. Though before coming to this Court, petitioner filed representation to the competent authority, but since nothing was done, he is compelled to approach this Court in the instant proceedings. 4. Having regard to the nature of prayer and order proposed to be passed in the instant petition, this Court sees no necessity to call for the reply from the respondents, who are otherwise represented by Mr. Rajan Kahol, learned Additional Advocate General. Mr. Kahol, fairly states that representation filed by the petitioner, if not already decided, shall be decided expeditiously. 5. Consequently, in view of the aforesaid fair stand adopted by learned Additional Advocate General, this Court, without going into the merits of the case, deems it fit to dispose of the present petition with a direction to the respondents to consider and decide the representation of the petitioner (Annexure P-3) expeditiously, preferably within a period of four weeks from today. Ordered accordingly. Needless to say, authority concerned, while doing the 2
needful in terms of instant order, shall afford an opportunity of being heard to the petitioner and pass speaking order thereafter. Pending applications, if any, stand disposed of.
