The instant application has been preferred seeking following main relief(s):- "Wherefore, it is most respectfully prayed that this Hon'ble Court may kindly be pleased to set aside/quash the impugned cognizance and summoning order dated 18.09.2019 passed by the learned Judicial Magistrate, First, Lucknow in Complaint Case no.227 of 2019, Archana Mishra Versus Rakesh Kumar Mishra as contained in Annexure no.1 to this petition and further the entire proceedings of Complaint Case no.227 of 2019, Archana Mishra Versus Rakesh Kumar Mishra arising out of the Complaint dated 24.04.2019 as contained in Annexure no.5 to this petition be also set aside/quashed, otherwise, the petitioner will suffer irreparable loss and injury which cannot be made good in any event." 3. Judicial Magistrate-Ist, Lucknow (in short "Magistrate") vide order impugned dated 18.09.2019 passed in Misc. Case No. 227 of 2019 (Archana Mishra vs. Rakesh Kumar Mishra) has summoned the applicant/Rakesh Kumar Mishra to face the trial for the offence punishable under Section 500 IPC. The order dated 18.09.2019 reads as under:- " पततवलल आददशतरर पदश हहयल। पररवतददनल कक ओर सद पररवतदपत पसततत कर दवपकलगण कक बततर अदभयतकगण तलब करनद कक यतचनत कक गयल हह। ससकदप मम पररवतददनल कत करन हह दक पररवतददनल कद जदठ रतकद श कत मतर दतवतरल व जदठतनल असजज दमशत अनतयतस बदवजह अकसर पररवतददनल कद ससतर रतमकद वल व सतस शलमतल शतरदत दमशत कद सतर मतरपलट व झगडत करतद हह। जजसकद कतरण पररवतददनल कद सतस ससतर नद धतरत 452,504,506 भत.दस.दव. कद तहत पररवतददनल कद जदठ जदठतनल कद दवरद घटनत दद. 21-9-18 कद बतबत एफआईआर दजर करतई। ततपशचतत दवपकल नद पररवतददनल जक दक सल हह, कक लजजत कत अनतदर करतद हहए मतनहतदन करतद हहए अनहदतक आरकप लगतयत। दवपकल नद कमतनतजधकतरल सदनत डतकघर कक पददषत पतररनतपत दद. 22-10-18 कद मतधयम सद झजठत आरकप लगतयत दक पररवतददनल कक दवपकल कक पतनल नद पररवतददनल कद सगद ससतर व दवपकल कद दपतत रतमकद वल दमशत कद सतर अनहदतक ससरदत मम ददखत जजसमम उनहम नहह हकनत चदहए। इस झजठद आरकप सद पररवतददनल जक दक एक सल हह, कक लजजत कत अनतदर हहआ हह और पररवतददनल कद पदत रदव कत मतर कक पजरल यजदनट मम पररवतददनल कक हतदन हहई हह। पररवतददनल नद अपनद अजधवकत कद मतधयम सद ददनतक 30-1-19 कक उक झजठद आरकप कद बतबत मतफक मतसगनद कक दवजधक नकदटस ददयत जजसकत ककई जवतब दवपकल दतरत नहह ददयत गयत। पररवतददनल दतरत अपनद पररवतदपत मम ददयद गए करनन कद समररन मम सवसय कक असतगरत धतरत 200 दस.प.सस. परलदकत करतयत हह तरत सतकलगण रदव कत मतर तरत शतरदत दमशत कक असतगरत धतरत 202 दस.प.सस. परलदकत करतयत गयत हह। महनद पररवतदल कद दवदतन अजधवकत कक सतनत तरत पततवलल कत पररशललन दकयत। पररवतददनल दतरत अपनद बयतन असतगरत धतरत 200 दस.प.सस. मम पररवतदपत मम कहद गए करनन कक पतनरतववजत कक गई हह। इसल पकतर सतकलगण रदव कत मतर तरत शतरदत दमशत नद भल अपनद बयतन असतगरत धतरत 202 दस.प.सस. मम पररवतददनल कद बयतनन कत समररन दकयत हह। ऐसद मम पततवलल पर उपलबध सतकय कद आधतर पर दवपकल रतकद श कत मतर दमशत कद दवरद धतरत 500 भत.दस.दव. कत अपरतध परम दषयत बनतत पतयत जततत हह। अतत दवपकल कक उक धतरतओस मम दवचतरण हदतत तलब दकयद जतनद कत आधतर पयतरप हह। आददश दवपकल रतकद श कत मतर दमशत कक धतरत 500 भत०दस०सस० मम दवचतरण हदतत जररयद सममन तलब दकयत जततत हह। पररवतददनल सजचल गवतहतन दतजखल करम, तदतपरतसत अदभयतक कक सममन जतरल हक। पररवतददनल आवशयक पहरवल दनयमतनतसतर अदवलसब करद। पततवलल वतसतद हतजजरल अदभयतकगण ददनतसक 04-10-19 कक पदश हक" 4. The relevant facts of the case, which borne out from the record, are as under:- (i) A letter dated 22.10.2018 was sent by the applicant/Rakesh Kumar Mishra to Command Officer, under whom the husband namely Ravi Kumar Mishra of the complainant/opposite party No. 2/Smt. Archana Mishra was discharging his duties. (ii) According to the letter dated 22.10.2018, the wife namely Smt. Anju Mishra of the applicant saw the complainant/opposite party No. 2 in compromising position/situation with her father-in-law (father of the applicant). A copy of this letter has been placed on record as Annexure No. 3 to the instant application. (iii) After the aforesaid letter dated 22.10.2018 sent by the applicant to the Command Officer, a letter/notice dated 30.01.2019 was sent by the complainant/opposite party No. 2 through counsel to the applicant. (iv) The aforesaid letter/notice dated 30.01.2019 prima facie indicates that the letter dated 22.10.2018 was opened by the concerned Command Officer and after going through the allegations levelled by the applicant therein against the complainant/opposite party No. 2 she was informed and therefore, the notice dated 30.01.2019 was sent by her to the applicant. (v) The husband (Ravi Kumar Mishra) and mother-in-law (Smt. Sharda Mishra) of the complainant/opposite party No. 2 were produced by her before the Magistrate and their statements were recorded as required under Section 202 Cr.P.C. These statements have been placed on record as Annexure No. 6 to the instant application and a perusal whereof would indicate that these witnesses supported the complaint case instituted by the opposite party No. 2 and indicated by her before the Magistrate while giving statement under Section 200 Cr.P.C. 5. Upon due consideration of the aforesaid facts and also the ingredients to attract the offence as indicated under Section 500 IPC as well as the law on the issue, this Court finds no force in the instant application.
