The instant application has been filed by the applicant seeking anticipatory bail in F.I.R./Case Crime No.03 of 2001 under Sections 409 I.P.C. B.N.S. registered at Police Station- Jalalpur, District- Ambedkar Nagar. 3. Learned counsel for the applicant has submitted that the applicant did not get any information or summons after that and he has applied for anticipatory bail when he has received a non-bailable warrant. 6. Although it is mentioned in the order dated 22.05.2025 passed by the Sessions Judge, Ambedkar Nagar rejecting the applicant's anticipatory bail application that proclamation under Section 82 Cr.P.C. has been issued against the applicant but as per the instructions provided to the learned AGA, no such proclamation has been issued against the applicant. 7. Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that the allegation levelled in the FIR lodged in the year 2001 is merely regarding 150 empty sacks of food grain having gone missing; a Division Bench of this Court had stayed the arrest of the applicant and that the applicant has no previous criminal history and presently the applicant has attained the advanced age of 80 years, I am of the view that the aforesaid facts are sufficient for making out a case for granting anticipatory bail to the applicant. 11.
