4. Present writ petition has been filed on behalf of the petitioner under Article 226 of the Constitution of India alongwith compounding application i.e. paper no.24 which is supported with the affidavits of petitioner and respondent no.3 and the same is endorsed by learned counsel for the parties.
5. Petitioner as well as respondent no.3 are present in the Court. They are duly identified by their respective counsel.
6. By means of this writ petition has sought quashing of the impugned FIR No.0049 of 2025 under Section 64 of B.N.S. registered at P.S. Kotwali, Tanakpur, District Champawat.

Learned counsel for the parties have filed their respective affidavits along with the compounding application stating therein that they do not wish to pursue the present criminal case any further and a compromise has been entered between them.
8. Learned State counsel has opposed the compromise application with the contention that as per the FIR serious allegations had been made by the complainant against the petitioner of sexually exploiting her and using abusive language; hence the present compounding
application should not be entertained.
9. This Court interacted with the complainant as to whether the allegations, so made and the contents of the FIR are serious; she in turn replies that the said complaint had been made by mistake and she does not want to pursue the matter any further.
10. Heard learned counsel for the parties and perused the material available on record.

In view of the principle of law laid down by Ho’ble the Apex Court in the case of Gian Singh vs. State of Punjab reported in 2012 (10) SCC 303, criminal proceedings can be quashed by this Court, if this Court is satisfied that matter has been settled between the parties amicably and parties are interest to restore peace and harmony between them.
12. Having heard learned counsel for the parties and in view of the above, the compounding application is allowed. The impugned FIR No.0049 of 2025 under Section 64 of B.N.S. registered at P.S. Kotwali, Tanakpur, District Champawat is hereby quashed.
13. Accordingly instant writ petition stands
disposed of.
