KNOWN TO THE PETITIONER, AGED ABOUT 40 YEARS, SUB INSPECTOR OF POLICE, (NOW VACANCY RESERVE) GIDDALURU POLICE STATION, GIDDALURU, PRAKASAM DISTRICT ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus (a) declaring the inaction on the part of the 4 and 5 respondents that they failed to prevent the commission of cognizable offence in spite of the petitioner complaint dated 19-05-2020 and having knowledge of committing the offence by the culprits (b) declaring the inaction on the part of the respondents 4 and 5 in failure to register the petitioners complaint dated 19-05-2020 as FIR as against the named accused therein (c) declaring the inaction on the part of the 3rd respondent in taking action against the 5th respondent and others culprits pursuant to the Written Complaint dated 20-05- 2020 submitted by the petitioner, as illegal, arbitrary and offending Articles 14 and 21 of the Constitution of India, (d). consequently direct the respondents 3 and 4 herein to consider and take appropriate action against the 6th respondent and others pursuant to the Written Complaint of the petitioner dated 19-05-2020 and 20-05-2020, investigate into the crime and file Final Charge Sheet against them, and to pass IA NO: 1 OF 2020 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents 3 and 4 herein to consider and take appropriate action against the 5th respondent and other named accused in Written Complaint dated 20-05-2020 and 19-05-2020 submitted by the petitioner, pending disposal of the Writ Petition, and pass Counsel for the Petitioner: 1. When the matter was taken up for hearing, learned counsel for the petitioner would submit that the petition may be disposed of, since the relief has become infructuous in this matter. 3. Learned Assistant Government Pleader for Home for the respondents is in attendance. 4. Recording the above said submission, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.
