Heard Sri Suresh Chandra Srivastava, learned counsel for the petitioners, Sri Akhilesh Kumar Srivastava, learned A.G.A. for the State-respondents and perused the material placed on record. 2. In view of the proposed order being passed, notice to respondents No. 3 is hereby dispensed with. 3. By means of the present writ petition, the petitioners have assailed the following prayers: "(i) Issue a writ, order or direction in the nature of certiorari quashing the impugned First Information Report dated 02.04.2025 lodged by Opposite Party no. 3 contained at Annexure No. 1 to this writ petition against the petitioners, which has been registered as Case Crime No. 0255/2025, under Sections 85, 115(2), 352, 351(2) BNS, Section 3/4 D.P. Act and Section 3/4 of the Muslim Women (Protection of Rights on Marriage) Act, 2019, Police Station Kotwali Nagar, District Sultanpur, in the interest of justice. (ii) Issue a writ, order or direction in the nature of mandamus commanding the opposite parties, not to arrest the petitioners on the basis of the aforesaid First Information Report dated 02.04.2025 contained at Annexure No. 1 to this writ petition." 4. Learned A.G.A. on the basis of specific written instruction, has informed that during the course of investigation, the name of petitioner nos. 2 to 7 have been deleted and against the petitioner no. 1, who is the husband of the Versus Counsel for Petitioner(s) : Suresh Chandra Srivastava, Vaibhav Srivastava Counsel for Respondent(s) : G.A. Suhel Beg And Others .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Home Lko. And Others .....Respondent(s) opposite party no. 3, charge-sheet has been filed only under Section 3/4 of the Muslim Women (Protection of Rights on Marriage) Act, 2019, wherein the punishment is upto seven years. The aforesaid instruction is taken on record. 5. In the wake of aforesaid development, nothing remains to be adjudicated in this writ petition, therefore, this writ petition is consigned to record.
