Heard Sri Salman Abbas, the learned counsel for the applicant as well as Sri Diwakar Singh, the learned A.G.A. for the State and perused the records. 2. The instant application has been filed seeking release of the applicant on bail in Case Crime No. 411/2017, under Sections 420, 406, 467, 468, 471 IPC, Police Station Gazipur, District Lucknow. 3. The aforesaid case has been registered on the basis of an F.I.R. lodged on 30.05.2017 stating that the informant had made investments in Umeed Trading Company but no return was paid on the investments. 4. In the affidavit filed in support of the bail application, it has been stated that the applicant is innocent and he has been falsely implicated in the present case. The applicant's involvement in 30 other cases has been disclosed in paragraph 20 of the bail application, in 4 of which he stands acquitted, proceedings of 2 cases have been quashed and the applicant has been ordered to be released in 13 cases of similar nature. 5. The applicant's wife Firdous has been granted bail in the present case by means of an order dated 23.05.2024 passed by a coordinate bench of this Court in Criminal Misc. Bail Application No. 3044 of 2024. 6. Learned AGA has opposed the bail application and he has submitted that the allegations have been established during investigation and a charge sheet has been submitted on 21.07.2025. 7. Having considered the aforesaid facts and circumstances of the case and keeping in view that the grievance of the applicant is regarding non-refund of investment made in a company; the applicant is in custody since 19.06.2021 whereas the investigation already stands concluded and a co-accused person has already been granted bail, I am of the view that the applicant is also entitled to be released on bail. 8. Accordingly, this bail application stands allowed. 9. Let the applicant-Rukhsar Ahmad Shah be released on bail in the aforesaid case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to the following conditions: - (i) the applicant shall not tamper with the prosecution evidence; (ii) the applicant shall not pressurize the prosecution witnesses; (iii) the applicant shall appear on each and every date fixed by the trial court.
