Heard learned counsel for the petitioner and learned Standing Counsel for the State respondents. 2. This writ petition has been filed with the following main prayer:- "(i). Issue a writ, order or direction in the nature of MANDAMUS commanding the opposite party nos.2 to 4 to construct the pakka drain beside the house of the petitioner situated in the abadi land by getting the help of police authorities in nagar panchayat at Shivrajpur Gadwara, District Pratapgarh." 3. Learned counsel for the petitioner submitted that respondent nos.5 to 8 are opposing the construction of pakka drain next to the boundary wall of the petitioner. The petitioner's house situated in Village Shivrajpur had been constructed over 40 years ago. Now the village Shivrajpur has come within the municipal limits and the Corporator of Ward No.11 Shivrajpur, Nagar Panchayat Gadwra, Pratapgarh has also issued a certificate in this regard. There is an endorsement on such certificate that the Chairperson, Nagar Panchayat, Shivrajpur, has taken such letter of the Corporator of Ward No.11 into account but the construction of drain cannot take place as there is a dispute between the parties. 4. This writ petition is disposed of with a direction to the petitioner to file a civil suit for his rights against the private respondent nos. 5 to 8 before the appropriate Court.
