Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record. The instant application under section 482 Cr.P.C./528 of the B.N.S.S.,2023, has been filed with the prayer to direct the court concerned in Sessions Trial No. 917 of 2023, Case Crime No. 0252/2023, under sections 380,411,413,457 of the I.P.C., Police Station-Gangaghat, District-Unnao, pending in the court of Additional District & Sessions Judge, Court No. 5, Unnao to not compel the applicant for filing fresh sureties in pursuance of the order dated 25-06-2025 passed by Incharge Sessions Judge, in Second Bail No. 1795 of 2025 and to accept the sureties already filed by the applicant in the abovementioned case crime number. Learned counsel for the applicant submits that the applicant has already been enlarged on bail in Case Crime No. 252 of 2023. Thereafter, the warrant was issued and the Second Bail was moved, wherein he has been enlarged on bail. He next submits that the same sureties may be accepted for the second bail as well. Learned counsel appearing for the State has no objection to the contentions aforesaid. In view of the aforesaid submissions and considering the ratio of Judgment rendered by the Hon'ble Supreme Court in the case of Hani Nishad @ Mohammad Imran @ Vikky vs. The State of Uttar Pradesh [SLP (Crl.) No.8914- 8915/2018, Order dated 29.10.2018),the Chief Judicial Magistrate concerned is directed to accept which are furnished in the first bail application for the second bail application.
