Neutral Citation No. - 2025:AHC-LKO:11496 Court No. - 5 Case :- WRIT - A No. - 7639 of 2024 Petitioner :- Pooja Panday Respondent :- Union Of India Thru. Secy. Ministry Of Health Family Welfare New Delhi And 2 Others Counsel for Petitioner :- Manish Mani Sharma Counsel for Respondent :- A.S.G.I.,Amita Srivastava,Gyanendra Kumar Srivastava,Rajiv Srivastava Hon'ble Abdul Moin,J.
1. Heard learned counsel for the petitioner, Shri Rajiv Srivastava,
learned counsel for the respondent No.2 and Shri Gyanendra Kumar Srivastava, learned counsel appearing for respondent No.3. Notice on behalf of respondents No.1 has been accepted by learned A.S.G.I.
2. With the consent of learned counsel appearing for the contesting parties, the writ petition is finally being disposed of.
3. At the very outset, learned counsel appearing for the petitioner states that the petitioner does not want to press the writ petition so far as it pertains to raising challenge to the order dated 22.08.2023 which has been passed by respondent No.2 and prays that as the application for having the name of the petitioner entered in the registers of Nurses, Midwives, Assistant Midwives etc., is pending for
consideration before respondent No.3 as such respondent No.3 be
directed to take a decision in the matter.
4. Further contention is that the petitioner has applied for her registration under the provisions of United Provinces Nurses, Midwives, Assistant Midwives, Auxiliary Nurse Midwives and Health Visitors Registration Act, 1934 (hereinafter referred to as 'Act, 1934') vide her application dated 19.04.2023, a copy of which is Annexure- 10 to the petition, yet no decision has been taken on the said application.
5. Considering that the application of the petitioner for being registered under the provisions of the Act, 1934 is pending
consideration before respondent No.3 consequently the writ petition is
disposed of with a direction to the respondent No.3 to take a final decision on the pending application of the petitioner in accordance with law under relevant rules and the Act, 1934, which decision shall be taken within a period of four weeks from the date of receipt of a certified copy of this order.
6. It is made clear that this Court has not gone into the merits of the claim set forth by the petitioner.
