Bordoloi, learned counsel for the petitioner. Also heard Mr. M. P. Goswami, learned Additional Public Prosecutor for the State of Assam. 2. This is an application filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, challenging the orders passed by the learned Judicial Magistrate First Class, Tezpur, Sonitpur in N.I. Case No.08/2022, directing issue of non-bailable warrant of arrest against the present petitioner, Manash Jyoti Koch. 3. The petitioner had defaulted in appearance before the Trial Court, therefore the Trial Court directed issue of non-bailable warrant of arrest against him. Today the petitioner has explained the reasons as to why he could not appear before the Trial Court, this Court is satisfied with the reasons. 4. Therefore, the prayer of the petitioner is allowed. 5. All orders directing issue of non-bailable warrant of arrest against the present petitioner, Manash Jyoti Koch in N.I. Case No.08/2022, pending before the learned Judicial Magistrate First Class, Tezpur, Sonitpur are set aside. 6. The petitioner, Manash Jyoti Koch is directed to appear before the learned Judicial Magistrate First Class, Tezpur, Sonitpur on 19.07.2025, on his appearance, the petitioner, Manash Jyoti Koch shall be allowed to go on fresh bail of Rs.20,000/- with a surety of like amount to the satisfaction of the learned Judicial Magistrate First Class, Tezpur, Sonitpur.
