SHAIK KHAJA BASHA The Court made the following: THE HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITON NO.12055 OF 2016 ORDER: The present Writ Petition is filed under Article 226 of the Constitution of India seeking following relief: “to issue a writ, order or direction more particularly in the nature of a writ of Mandamus directing the respondent No.2 to dispose of the representation of the petitioner dated 21.01.2016 for constitution of the Managing Committee of Noor Masjid, Naidupeta, SPSR Nellore District by appointing the petitioner as the President and other office bearers in consultation with the President or with any other suitable persons as the second respondent deems it fit and proper…” 2. No representation on behalf of the petitioner. Heard learned counsel for the respondents. 3. Learned counsel for the respondents submits since the prayer in the present writ petition is only for disposal of the representation dated 21.01.2016 submitted by the petitioner seeking for constitution of the Managing Committee of Noor Masjid, Naidupeta, SPSR Nellore District by appointing the petitioner as the President and other office bearers in consultation with the President, let there be a direction to the respondent authorities to consider the representation dated 21.01.2016 submitted by the petitioner. He further submits that if the said representation submitted by the petitioner is otherwise in order, the respondents shall consider the same in accordance with law. 4. Having regard to the submissions made by the learned counsel for the respondents and on perusal of the material placed on record, without going into merits of the case, this Court is of the considered view that the present writ petition can be disposed of, directing the respondent authorities to consider and dispose of the representation dated 21.01.2016 submitted by the petitioner, in accordance with law, as expeditiously as possible. If the said representation is not available with the respondents, the petitioner is at liberty to submit a fresh representation ventilating his grievance. On receipt of the said representation, the respondents are directed to consider and dispose of the same, in accordance with law. 5. With th e above direction, the writ petition is disposed of. There shall be no order as to costs.
